Terms and Conditions

Introduction

Welcome to Golfective. These Terms and Conditions ("Terms") govern your use of the Golfective mobile application (the "App"), developed and operated by João Martins, an independent developer based in Portugal. By accessing or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.

Acceptance of Terms

By creating an account and using Golfective, you confirm that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• All information you provide is accurate and complete
• You will comply with all applicable laws and regulations

User Account

To use certain features of Golfective, you must create an account using your email address or a supported third-party login (Google or Sign in with Apple). You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Providing accurate and up-to-date information

We reserve the right to suspend or terminate accounts that violate these Terms.

Subscription and Payment

Golfective offers both free and paid subscription plans:

• Free Plan: Access to core features with daily limits (2 swing recordings and 1 video import per day)
• Pro Plan: Unlimited recordings and imports, full saved-swing history, and the aggregated statistics dashboard

Paid subscriptions are billed monthly or yearly, at the prices displayed in the App at the time of purchase. Prices may vary by region. Payments are processed by the Apple App Store (iOS) or Google Play Store (Android), using the payment methods linked to your store account. Your subscription will automatically renew for the same period unless cancelled at least 24 hours before the end of the current billing period. You may cancel your subscription at any time in the Apple App Store or Google Play subscription settings — not from inside the App. Cancellation takes effect at the end of the current billing period — you will retain access to Pro features until then. Refunds are handled by Apple or Google according to their respective policies and applicable law.

Video Recording and AI Analysis

The App uses your device camera to record golf swing videos. These videos are:

• Stored locally on your device — the original video file is never uploaded to our servers
• Processed on-device using AI-based object detection models to analyse your swing

When you explicitly save a swing, the App uploads only the numeric results of the analysis (such as tempo, swing-phase frame indices, and the setup / head-stability / swing-plane / impact metrics) to our database. This is what powers your saved-swing history and your statistics dashboard. The original video file is not part of that upload.

If you opt in to "AI training frame contribution" in Settings, the App may additionally upload up to one still image per day, extracted from your swing, to improve our analysis model. See the Privacy Policy for details.

The AI analysis provides swing metrics for training purposes only. These metrics are estimates and should not be relied upon as precise measurements. We do not guarantee the accuracy of the AI analysis results.

User Content

You represent and warrant that any content you record, import, or upload through the App (including golf swing videos) is your own original content or that you have obtained all necessary rights and permissions to use it.

You are solely responsible for the content you create, record, or import into the App. Golfective does not claim ownership of your content and bears no responsibility for user-generated content.

By using the App, you confirm that your content does not infringe on the rights of any third party, including copyright, trademark, privacy, or other personal or proprietary rights.

User Conduct

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or infrastructure
• Interfere with or disrupt the App's functionality
• Upload harmful code, viruses, or malware
• Reverse engineer, decompile, or disassemble the App
• Violate any intellectual property rights
• Use automated systems, bots, or scrapers to access the App without permission

Intellectual Property

All content, features, and functionality of the App, including but not limited to:

• Software code, algorithms, and AI models
• User interface design and graphics
• Logos and trademarks
• Text, images, and videos
• Swing analysis methodologies

are the property of João Martins and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without prior written permission.

Your swing videos and personal data remain your property. By using the App, you grant us a limited license to process this data solely for the purpose of providing the App's services to you.

Limitation of Liability

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee:

• Uninterrupted or error-free service
• Specific results or improvements from using our training tools
• Accuracy of swing analysis, metrics, or statistics
• Compatibility with all devices

To the maximum extent permitted by Portuguese law, João Martins shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data, loss of profits, or personal injury.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

Governing Law

These Terms are governed by and construed in accordance with the laws of Portugal. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the Portuguese courts.

If you are a consumer residing in the European Union, you may also benefit from mandatory provisions of the consumer protection laws in your country of residence. You may also use the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

Termination

We reserve the right to:

• Suspend or terminate your account for violation of these Terms
• Remove content that violates these Terms
• Discontinue the App or any features with reasonable notice when possible

You may terminate your account at any time from Settings → Account → Delete Account. Account deletion is performed server-side and, in a single operation, permanently removes your saved swings, your aggregated statistics, your AI training frames, your user profile and your authentication account. Upon termination:

• Your right to use the App ceases immediately
• Active subscriptions in the Apple App Store or Google Play are NOT cancelled by account deletion — you must cancel them separately in the store settings to stop billing. Refunds are handled by Apple or Google according to their respective policies
• Your saved swings and aggregated statistics are deleted in accordance with our Privacy Policy
• Certain provisions of these Terms (Intellectual Property, Limitation of Liability, Governing Law) will survive termination.

Changes to Terms

We may update these Terms from time to time. When we make material changes:

• We will update the "Last updated" date
• We will notify you through the App or by email
• Continued use of the App after notification constitutes acceptance of the new Terms

If you do not agree to the updated Terms, you should stop using the App and terminate your account.
